Introduction: These Terms and Conditions govern all use of Kirkby Lonsdale Health & Spa Club’s facilities, services, and memberships. By becoming a member of or visiting Kirkby Lonsdale Health & Spa Club (the “Club”, “we” or “us”), you agree to abide by the following terms. These terms are designed to ensure a safe, enjoyable, and legally protected environment for all members, guests, and staff. If you do not agree to any part of these Terms and Conditions, you should not use our facilities. We reserve the right to update these terms periodically, and will notify members of significant changes as described below.

1. Membership Eligibility and Application

  • Minimum Age: Membership is open to individuals 16 years of age or older. Members under 18 may be required to have a parent or legal guardian co-sign the membership agreement and must have parental consent. Children and minors are welcome in designated areas or activities with appropriate supervision (see Section 9 on children’s access).

  • Health and Fitness Warranty: By applying for membership, you certify that you are in good physical condition and know of no medical or other reason why you should not exercise. You confirm that any health or medical information you provide to us (e.g. in a Pre-Exercise Questionnaire or health assessment) is accurate and complete, and that you will inform us of any significant changes to your health. If you have concerns about your physical condition, do not engage in strenuous physical activities without first consulting a medical professional. You should only undertake activities that you are fit for, and you are responsible for monitoring your own physical condition during any exercise. (See also Section 6 on Health & Safety.)

  • Discretion to Accept Members: The Club reserves the right to accept or reject any membership application at our sole discretion. All memberships are personal and non-transferable – only the individual named on our records may use the membership (you may not loan or give your membership card or credentials to others). We may require a photograph and/or identification upon joining and for entry verification.

  • Sex Offender and Criminal History Policy: For the safety and comfort of our community, we will not permit registered sex offenders to join or access the Club. We reserve the right to screen applicants and members against sex offender registries, and to deny or terminate membership or entry to any person who is a registered sex offender or who has been convicted of offenses involving sexual abuse, violence, or other serious crimes. We also may deny access or membership to anyone whose behavior or background, in our judgment, poses a risk to the well-being, safety, or comfort of other members, guests, or staff. By agreeing to these terms, you represent that you are not on any sex offenders register. If it comes to our attention that a member or guest has misrepresented this or otherwise poses a serious risk, we will take immediate action including notifying authorities if appropriate.

  • Membership Types and Terms: We offer various membership plans (e.g. individual, couple or  child memberships). The specific terms of your membership (such as contract length, monthly dues, initiation fees, etc.) will be stated in your membership agreement or ClubRight online sign-up process. Unless otherwise specified, memberships run on a monthly rolling basis with no fixed end date. If a minimum initial commitment period applies to your membership (e.g. 12 months), this will be made clear at joining – after any such minimum term, membership will continue on a monthly rolling basis. All memberships begin when we accept your application and payment and issue you a member ID or account.

2. Fees, Dues, and Payment

  • Joining Fees and Dues: Upon joining, you agree to pay the recurring membership dues applicable to your membership category. Membership fees may be collected monthly by direct debit or recurring card payment through our membership portal (ClubRight) or annually in advance, as agreed at sign-up. All fees and pricing information will be communicated to you during the sign-up process. By providing your payment details and joining, you authorize us (and our payment processors) to collect dues and other fees (e.g. café charges, personal training, etc. if applicable) in accordance with your membership plan.

  • Payment Dates: Recurring membership dues will typically be charged on the same day each month (or the schedule stated in your agreement). It is your responsibility to ensure your payment method on file is current and has sufficient funds. If any payment fails or is returned (e.g. due to insufficient funds or an expired card), we will notify you, and we may attempt to reprocess the payment. We may also charge a reasonable administration fee for late or failed payments (you will be informed of any such fee in the price list or membership agreement).

  • Arrears and Suspension: If membership dues or any other fees remain unpaid 30 days past their due date, the Club reserves the right to suspend or terminate your membership and deny you access to the facilities until the account is brought current. We will contact you (at the last contact details provided) to remind you of any outstanding payments before taking such action. While your account is in arrears, no additional guests or linked members may use the Club under your membership, and any bookings or services may be suspended. You remain liable for any unpaid fees that accrue during a suspension.

  • Price Changes: Membership dues and other fees are reviewed periodically and may be increased from time to time. We will provide at least 30 days’ notice of any increase in your recurring membership fees (usually via email or via a notice on our website or at the Club). If you do not wish to accept a proposed fee increase, you have the right to cancel your membership (see Section 3 on cancellations) by giving us written notice within that 30-day notice period, to end your membership before the new rates take effect. Using the Club after a price change takes effect constitutes acceptance of the new fees.

  • No Refund Policy: All membership fees and prepaid dues are non-refundable except in the specific circumstances outlined in these Terms or as required by law. If you terminate your membership early (before the end of a prepaid period or minimum term) without an agreed qualifying reason (see Section 3), you will not be entitled to a refund for unused time, and you may be responsible for any remaining balance of the minimum term (if applicable). We do not provide refunds or credits for periods where the Club is unused by the member (e.g. due to vacation, minor illness, or simply not attending), aside from approved freezes or cancellations as described below.

3. Membership Cancellation, Freeze, and Termination

  • Your Right to Cancel: You may cancel your membership by giving written notice to the Club (e.g. via email or the ClubRight portal) at least one full calendar month in advance of your desired end date. The cancellation will take effect on the first day of the month following the completion of this notice period (for example, if you give notice on March 10, your membership will end on April 30). 

  • Special Circumstance Cancellations: We understand that certain circumstances might require ending your membership early. You may cancel with less than the normal notice if: (a) you are suffering from a medical condition that prevents you from using the Club’s facilities for an extended period (typically 2+ months) – a doctor’s note or medical evidence will be required; (b) you relocate your primary residence or workplace far from the Club (beyond a 30-mile/50-km radius, for example) – documentation of the move may be required; (c) you lose your employment/redundancy and can no longer afford the membership; or (d) any other circumstance that, at our discretion, warrants a compassionate release from contract. In all such cases, you must provide written proof and as much notice as possible. We may approve a cancellation with immediate effect or with a shorter notice period. Refunds for unused prepaid months in these cases will be prorated, minus any applicable administration fee to cover our costs.

  • Freezing/Temporary Suspension: As a courtesy, we may allow you to temporarily freeze (pause) your membership in certain situations, such as extended travel, pregnancy, or short-term injury/illness. Freezes are typically allowed for a minimum of one full month and up to a maximum of e.g. 3 months in a year (unless otherwise agreed). You must request a freeze in writing in advance, and we may require supporting documentation (e.g. medical note). During a freeze, a reduced “maintenance” fee may be charged (or no fee, at our discretion for medical freezes), and you will not have access to the Club during the freeze period. Your membership term will be extended by the length of the freeze.

  • Our Right to Terminate or Suspend: We may terminate your membership or suspend your access with immediate effect if you violate any of these Terms and Conditions or Club rules, or for any of the following reasons:

    • Serious or Repeated Misconduct: If you commit a serious breach of Club rules or conduct standards – for example, theft, violence, abusive behavior, willful damage to property, harassment of others, use of illegal drugs on premises, or any other conduct that we reasonably judge to be severely inappropriate or dangerous – we may cancel your membership immediately with no refund. Lesser offenses or repeated minor violations may also lead to suspension or termination if not resolved after a warning.

    • Providing False Information: If you provided false, inaccurate, or misleading information during your membership application (e.g. false health information or identity, or hiding a disqualifying criminal status such as a sex offender registration), or if you assisted unauthorized access (for example, sharing your membership card or letting non-members into the Club), this is grounds for termination.

    • Non-Payment: If your membership fees or other charges remain unpaid beyond 30 days despite requests (as noted in Section 2), we may terminate the membership for breach of contract. (We will still seek to collect any past due amounts owed up to the termination date.)

    • Health or Safety Reasons: If we determine that your continued membership poses a health or safety risk to yourself or others (for example, if you have a medical condition that makes use of our facilities dangerous and you ignore staff advice to obtain medical clearance, or if you have an infectious condition that poses risk), we may suspend or terminate your access until such risk is resolved.

    • Club Closure or Change of Offerings: In the unlikely event that we permanently close the Club or cease operations, your membership will terminate. We will provide as much notice as possible in such case, and if you have prepaid months remaining, we will refund the unused portion. In case of a relocation or major change in facilities that significantly alters your membership’s value, you may have the option to cancel (see Section 11 on Changes).

  • Effect of Termination: If your membership is terminated by us for cause (due to your fault), you remain responsible for any unpaid fees through the termination date. We reserve the right to charge a reasonable compensation or termination fee if applicable, for example retaining any prepaid amounts to cover the notice period. If we terminate without cause (e.g. Club closure) or you cancel validly with notice, we will refund any dues paid for periods after the effective cancellation date. Upon termination, you must return any Club property (e.g. membership cards) and settle any outstanding debts. You will no longer be authorized to access the Club. We also reserve the right to refuse any future application by individuals whose membership was terminated for misconduct.

4. Club Access and Security

  • Check-In Procedure: All members must check in at reception or at the entry turnstiles (if provided) on each visit, using their membership card, PIN, mobile app QR code, or other Club-issued identification. We may require photo identification for entry validation, especially if you have forgotten your membership card. Only the authorized member may use their membership credentials – sharing your membership card or allowing others to use your access is strictly prohibited and may result in cancellation of membership. For security, our staff may occasionally ask to verify your identity.

  • Guests: We welcome guests subject to the Club’s guest policy. Generally, an adult member in good standing may invite guests to the Club. All guests must: (a) be signed in at reception by the hosting member and provide their name and contact details; (b) present photo ID if requested; (c) pay the applicable guest fee (unless a free trial or complimentary pass applies); and (d) sign a waiver or agree to abide by Club rules. Guests are only allowed to use the facilities while accompanied by the host member, unless we specify special arrangements (such as a scheduled guest class or member guest entitlement). As a member, you are responsible for the conduct and safety of your guests. You must ensure your guests know and follow all Club rules. We reserve the right to limit the number of guests per member per day, restrict guest access times (e.g. peak hours), or refuse guest entry at our discretion. Guests who violate rules or behave inappropriately will be asked to leave, and the host member’s privileges may be reviewed.

  • Access Control: The Club may utilize video surveillance (CCTV) in public areas (see Privacy Policy) and on-site staff to monitor secure access. For everyone’s safety, keep all access doors closed. Members should not let anyone piggy-back or tailgate into the facility without proper check-in. If you forget your access card or fob, please see reception for assistance – do not sneak in or bypass entry systems. Unauthorized access or assisting unauthorized entry is a serious violation.

  • Operating Hours: The Club’s normal operating hours and schedule for specific facilities (pool, spa, classes, etc.) will be posted on our website and/or at the facility’s entrance. We reserve the right to adjust operating hours, class schedules, and facility availability (for example, closing areas for cleaning, maintenance, or private events). We will endeavor to give advance notice for significant changes to hours or temporary closures (e.g. notice of holiday hours or refurbishment closures posted on the notice board or via email). No refunds will be given for temporary closures or reduced hours, but if any facility is unavailable for an extended period (beyond 7 days consecutively) we may consider membership compensation or freeze options on a case-by-case basis.

  • ClubRight Portal: Upon joining, you will create a membership profile on our ClubRight system (accessible via web or app). You are responsible for managing your account details (keeping your contact info up to date) and for booking classes or services through the portal as required. Please protect your login credentials for the member portal and do not share them. The portal may send automated emails for confirmations, waitlist openings, etc., so we recommend you opt-in to receive email/SMS notifications to stay informed. Use of the portal is subject to its own terms of use as well.

5. Facilities and Equipment Usage Policies

General Code of Conduct: When using the Club, you are expected to behave in a respectful, safe, and considerate manner at all times. The following rules apply throughout all areas of the Club:

  • Respect for Others: Treat fellow members, guests, and staff with courtesy. Harassment, bullying, aggressive or lewd behavior, excessive profanity, or any form of discrimination will not be tolerated. Please keep noise to reasonable levels, and refrain from interrupting or intruding on others’ workouts.

  • No Alcohol or Illegal Substances: The consumption of alcohol is only permitted in designated café/bar areas (if we have a licensed bar) and only in moderation. Members and guests may not use the gym or other facilities while intoxicated. The possession, use, or distribution of illegal drugs or any banned performance-enhancing substances on Club premises is strictly prohibited. Anyone who appears to be under the influence of alcohol or drugs will be denied entry or asked to leave.

  • No Smoking: Smoking or vaping is not allowed inside the Club or at entrances. If the Club has a designated outdoor smoking area, that will be the only permissible place to smoke.

  • Proper Attire: You must wear appropriate athletic attire in all workout areas. Shirts/tops, shorts/leggings, and clean athletic footwear are required in the gym and studios (no street clothes or open-toed shoes on the gym floor). Swimwear is required in pools, spas, sauna/steam (a towel or robe is recommended in sauna/steam areas for hygiene). Please bring a towel to place on equipment seats and to wipe down sweat for hygiene. In pool areas, swim caps may be required in the lap pool (check local rules). We may refuse entry or ask you to leave an area if you are not properly attired for that activity.

  • Personal Belongings: For safety and cleanliness, bags, coats, and personal items should be kept in lockers and not brought onto the gym floor or poolside. We are not responsible for personal belongings lost or stolen on the premises (see Liability section). Do not leave any items in passageways or where they could be a trip hazard or block access.

  • Cell Phones and Cameras: No photography or video recording is allowed in certain sensitive areas such as locker rooms, changing areas, showers, restrooms, and sauna/steam rooms. We also strictly prohibit any cameras or phone usage that invades someone else’s privacy. In general workout areas, we ask that you be respectful with phone use: lengthy or loud phone calls should be taken outside or in the lobby (not on the gym floor), and absolutely no unsolicited filming/photography of other members. Recording other individuals without their consent is prohibited. If you do take a personal photo/video (e.g. form check or progress picture) in other areas, avoid capturing others in the background or obtain their permission. The Club staff may ask to inspect and delete any photos/video taken on premises if a complaint is raised.

  • Food and Drink: No food is allowed in workout areas (gym, studios, pool deck) except for light snacks like energy bars, and even then please be considerate and avoid any spillage. Only drinks in closed, non-breakable containers are allowed beyond the café. Chewing gum is discouraged (due to mess and choking hazard). Outside food and beverages: The Club may have a cafe or vending for your convenience; please do not bring large outside meals to eat in the clubroom or cafe seating area (except in designated picnic areas or with management permission). Only food and drink purchased on site may be consumed in our café/lounge areas. (Reasonable exceptions are made for baby food or specific dietary needs.) Alcohol from outside is strictly not allowed.

  • Club Equipment Care: Use all equipment and facilities in the proper manner, following any instructions provided by the Club (including on machine signage or explained by staff). Do not drop weights or misuse equipment (e.g., do not stand on benches, or use machines for purposes other than intended). If you are unsure how to safely use a piece of equipment, please ask a staff member for assistance. Clean up after yourself: re-rack weights, return any accessories (medicine balls, mats, etc.) to their proper place, and wipe down equipment after use with the provided disinfectant wipes or sprays. Chalk (for weightlifting) should be used sparingly and any residue cleaned. We may prohibit chalk entirely if it becomes a cleanliness issue. Members who intentionally damage equipment or facilities will be held financially responsible for repair or replacement costs, and it may result in termination of membership.

  • Personal Training and Coaching: To ensure quality and safety, only Club-employed or Club-authorized personal trainers/instructors may conduct personal training or coaching on the premises. You may not solicit or conduct personal training of other members within the Club if you are not employed or approved by us. Similarly, you should not accept training or instruction from any individuals not authorized by the Club. We do allow independent Personal Trainers to operate in our facilities only if they have entered into an agreement with the Club (including providing proof of qualifications and insurance). Any unauthorised trainers will be asked to leave, and members receiving unauthorized training may face membership review. Please note: If you choose to train with a freelance personal trainer who has been permitted to use our space, that trainer is an independent contractor and not an employee of the Club. We do not supervise their sessions and we are not liable for any injury or outcomes of advice you receive from an independent trainer (such trainers should have their own liability insurance). Nonetheless, all trainers (staff or freelance) must adhere to Club policies. If you observe any trainer (or member) engaging in unsafe practices, please report it to management.

  • Group Fitness Classes: If you participate in group exercise classes or activities, you may be required to book your spot in advance (via the ClubRight app or at reception) and adhere to any class-specific booking and cancellation policies. Please arrive on time for classes – instructors may deny entry to late arrivals as a courtesy to others and for adequate warm-up. If you need to leave early, inform the instructor before class. Follow the instructor’s guidance at all times during classes; they may give modifications, but you are always free to reduce intensity or stop if needed for your safety. Some classes have limited capacity or require specialty equipment – only those signed up may participate. If you miss multiple class bookings without canceling in advance, we reserve the right to enforce a penalty or suspend advance booking privileges (e.g. after three “no-shows” in 30 days, you might be blocked from booking for one week – exact policy will be posted). This is to ensure fair access for all members.

Specific Area Rules: In addition to the general code above, please adhere to the following rules for particular facilities:

  • Cardio and Strength Equipment (Gym Floor): Wipe down machines and benches after use. Allow others to “work in” (take turns) on equipment between sets if the gym is busy – do not monopolize one machine or station for extended periods. Observe any posted time limits on cardio machines during peak times (typically 20 or 30 minutes). For safety, no open-toe shoes or sandals on the gym floor; athletic shoes are required. When weightlifting, use safety clips on barbells and spotter assistance for heavy lifts. Dropping weights from overhead is prohibited except on designated lifting platforms with bumper plates (and even then, controlled lowering is required). Always be mindful of those around you when moving equipment or performing exercises. Report any malfunctioning or broken equipment to staff immediately; do not attempt to use or fix broken equipment.

  • Functional Training Areas and Studios: If using functional training rigs, boxing bags, or stretch areas, ensure you have adequate space. Do not move heavy equipment (like treadmill or bikes) without staff approval – small items like jump ropes or kettlebells may be moved but must be returned. In studios, use only the equipment designated for class use unless otherwise permitted. If a studio is free and not in use for a class, members may use it for personal workouts with respect: do not monopolize it if others wish to use, and keep music at a reasonable volume (ask staff if you can play music over speakers). Clean any mats or shared gear after use.

  • Swimming Pool: Shower before entering the pool to maintain hygiene. Appropriate swim attire is required (swim trunks, swimsuits, swim diapers for infants – no street clothes in pool). No running on the pool deck. No diving is permitted at any time. The pool area  is monitored by staff and CCTV but is not continuously supervised. A poolside emergency alarm/panic button is available for use if assistance is required. Users must take reasonable care for their own safety while swimming and using the pool facilities.  Children must be supervised in the pool: an adult (18+) member must accompany children under a certain age (typically under 16) in the water. Specifically, children under 16 must be actively supervised by a parent/guardian in the pool area at all times, and very young children or non-swimmers should be within arm’s reach of an adult. We may enforce a maximum ratio (e.g. 2 children per adult) for safety. If designated family swim times or adult-only swim times are introduced, these will be communicated and must be observed. No rough play, shoulder wars, or throwing children in the pool. Use of flippers, balls, or toys may be restricted depending on how busy the pool is (check with staff). All users must vacate the pool when requested at closing time or if an emergency is signaled (long whistle or alarm). Voices should be kept low to maintain a calm environment. Shaving, grooming, eating, or drinking is not permitted in spa facilities. Follow all posted instructions and staff guidance at all times.

  • Hot Tub/Spa Pool: A wall mounted control button activates the spa cycle for a limited period and will automatically switch off to allow the system to cool before it can be used again. A quick shower/rinse is encouraged before entering the hot tub as well. Do not use oils or soaps in the spa. For health and safety, we recommend limiting your soak to about 15 minutes at a time. Pregnant women, individuals with heart conditions, high blood pressure, or other serious health concerns should consult a doctor before using hot tubs.
    Age restriction: For safety reasons, no persons under the age of 16 are permitted to use the jacuzzi, sauna, or steam room under any circumstances. This rule applies at all times and is not affected by supervision.

  • Sauna and Steam Room: Shower before using the sauna or steam room (to keep them hygienic) and always sit on a towel in the sauna (for hygiene and to prevent burns on hot wood). Users must shower after using the sauna or steam room before entering the pool or other facilities. For steam, you may also want a towel for seating if desired. These high-heat facilities are meant for relaxation – please keep voices low. Water must not be poured onto the sauna rocks at any time. For steam rooms, do not use eucalyptus oils or other aromatic products unless provided or permitted (some can damage the system). We advise limiting sessions to ~10-15 minutes and cooling down in between. Age restriction: Children under 16 are not permitted in sauna or steam rooms. Absolutely no shaving, food, or personal grooming inside these rooms. People with health conditions (heart disease, low blood pressure, pregnancy, etc.) should consult a doctor before use. If you feel faint or unwell, leave immediately and inform staff.

  • Ice Bath/Plunge Pool: If the Club offers cold plunge or ice baths, these should be used with caution. Cold exposure can be risky – do not use if you have cardiovascular issues or other health concerns unless cleared by a physician. Limit time to short intervals (e.g. 1-3 minutes at a time, unless you are experienced). Never submerge your head underwater in an ice bath. We require that at least one other person is nearby or aware when you use the ice bath, for safety (do not use it completely alone behind closed doors). Children under 16 should not use ice baths (the shock can be dangerous for them).

  • Changing Rooms and Lockers: No cameras or phone usage is allowed in locker/changing areas for everyone’s privacy. Please be considerate of others’ space and privacy in the locker room. We provide lockers for your convenience – however, usage is at your own risk. Do not leave valuables unsecured. It is your responsibility to properly lock your locker (bring a padlock or use our digital locks as available). Daily Use Only: Lockers are for day-use unless you have specifically rented a locker. Items left overnight in day-use lockers may be removed by staff. We will hold removed items in lost-and-found for a reasonable period (e.g. 2 weeks); unclaimed items may be donated or disposed of. The Club is not liable for theft or loss of items from lockers or changing rooms to the maximum extent permitted by law. Please report any incidents of theft or suspicious behavior immediately so we can investigate. For security, staff may conduct bag checks or locker checks if there is reason to suspect prohibited items or safety issues (we will always respect your privacy and follow proper procedure if such a check is needed).

  • Showers and Restrooms: No shaving or personal grooming in the sauna/steam; use the sinks or showers for that and dispose of razors properly (or in provided bins if available). Glass containers are strictly prohibited in all wet areas – broken glass can shut down a pool/shower area for hours. Notify staff if any cleaning or maintenance issue arises (e.g. lack of soap, slippery floor).

  • Towels: We request that members bring their own towels for workouts and showering (unless the Club provides a towel service). If towels are provided, please return used towels to the designated drop bins. Do not remove Club towels from the premises.

  • Lost Property: Any items found by staff or turned in will be kept in our lost property box at reception. We will log valuable items (phones, jewelry, wallets) and secure them; you will need to describe the item to claim it. Items unclaimed after a set period (usually 30 days) may be donated to charity or disposed of. The Club is not responsible for loss or damage to personal property, as noted in the Liability section, but we will do our best to return found items to their owners.

  • Parking: (If applicable) Parking on our premises is at your own risk. The Club does not accept liability for any loss, theft or damage to vehicles or belongings left in vehicles in our parking lot. Please park considerately within marked bays and observe any disabled or reserved space rules. We are not responsible for any fines or towing if you park improperly. Bicycles should be locked at designated bike racks; we are not responsible for theft/damage to bikes on site.

  • Prohibited Items and Activities: For everyone’s safety and comfort, the following are not allowed on Club property:

    • Weapons: No firearms, knives (other than small pocket or butter knives), or any other weapons are permitted, even if you have a legal permit to carry them. The only exception is for on-duty law enforcement officers or individuals who have obtained prior written permission from Club management (e.g. for a supervised self-defense class demonstration).

    • Hazardous Materials: No flammable, explosive or toxic substances. For example, do not bring propane tanks, car batteries, or open paint cans into the building.

    • Outside Trainers or Instructors: As noted, you cannot conduct business or solicit other members without approval.

    • Commercial Activities: You may not advertise or sell products/services on the premises without written authorization from management. This includes posting flyers, hosting events, or using the Club as a backdrop for commercial photo or video shoots, unless we agree in advance.

    • Animals: Pets are not allowed inside the Club (except for service animals). Service animals (dogs or other animals specifically trained to assist persons with disabilities) are permitted to accompany those members or guests who rely on them, in accordance with applicable law. Emotional support animals or untrained pets are not considered service animals and are not allowed. If you bring a service animal, it must be under your control at all times (e.g. on a leash if appropriate). We reserve the right to ask you to remove the animal if it poses a direct threat to others, is not housebroken, or is out of control (and you do not take effective action to control it). You are responsible for any damage caused by your animal.

6. Health and Safety Acknowledgment

  • Member’s Responsibility: Your health and safety is of paramount importance to us. However, it is ultimately your responsibility to ensure that you are healthy enough to exercise. By using our facilities, you acknowledge and agree that you are voluntarily engaging in physical exercise, which may involve inherent risks of injury, strains, or other health issues. You agree to assume full responsibility for any risks, injuries or damage, known or unknown, which you might incur as a result of participating in activities at the Club. You should monitor your condition at all times and not push beyond your own limits. If at any point you feel faint, dizzy, experience pain or shortness of breath, stop immediately and inform a staff member if you need assistance.

  • Health Consultations: We strongly recommend that you consult with your doctor before starting any new exercise program, especially if you have any pre-existing medical conditions, are pregnant, or have been inactive. If you have any condition that might be affected by exercise (such as heart disease, hypertension, orthopedic issues, diabetes, etc.), you must get medical clearance. By using the Club, you confirm that either (a) you have had a recent medical check-up and have your doctor’s approval to exercise, or (b) you have decided to exercise without such consultation and accept responsibility for that decision.

  • Medical Disclosure: Please inform us of any relevant medical or health issues when you join and any time your health status changes. This includes pregnancies, injuries, illnesses, or any condition that may affect your ability to safely use our facilities or that we should be aware of in case of emergency (for example, asthma, epilepsy, severe allergies). We keep this information confidential (see Privacy Policy), but it helps us assist you and design appropriate programs. You are also asked to provide an emergency contact name and number; ensure this is kept up to date on your membership profile.

  • Orientation and Instruction: We offer all new members an optional free orientation session to familiarize yourself with the gym equipment and safe exercise techniques. We highly encourage you to take advantage of this orientation, especially if you are new to exercise or unfamiliar with certain equipment. While our staff and trainers can provide guidance, remember that you exercise at your own risk and we cannot supervise every activity. If you ever have questions about how to use equipment or how to work out safely, please ask one of our qualified instructors – that’s what we’re here for.

  • Cleanliness and Hygiene: We maintain high standards of cleanliness. We ask members to do their part: wipe down equipment after use, shower before pool/spa use, and practice good personal hygiene. If you have (or recently had) a contagious illness (such as flu, COVID-19, stomach bug, or a skin infection), please refrain from using the Club until you are no longer contagious to avoid spreading illness. We reserve the right to ask anyone visibly ill to leave and come back when well, for the health of others. In certain cases, we may temporarily restrict facility usage or require health screenings in line with public health guidance (for example, temperature checks during pandemics).

  • Accidents and Incidents: If you are injured or involved in an incident on our premises, please notify a staff member immediately. We have trained first aid personnel and first aid kits available on site. By policy, we document accidents and injuries in an incident report. If urgent medical attention is required, we will call emergency services (ambulance) for you. We are not responsible for any medical costs you incur for treatment of an injury at the Club; you are responsible for your own health insurance coverage. Members are encouraged to have a personal insurance policy that covers accidents or injuries (many home or health insurance policies have such riders for gym use).

  • Liability Waiver: By using our facilities, you agree to release and hold harmless Kirkby Leisure Club Ltd and its owners, directors, employees, trainers, and agents from any liability for any injury, illness, death, loss, or damage that may result from your use of the Club, to the fullest extent permitted by law. This includes, without limitation, injuries arising from the use of exercise equipment, participation in supervised or unsupervised activities, slips or falls, contact with other members, and any negligence on your own part. You acknowledge that participation in physical exercise and use of fitness facilities carry an inherent risk of physical injury – by signing your membership agreement or using the Club, you acknowledge and accept such risks except where caused solely by the gross negligence or willful misconduct of the Club. Nothing in these terms seeks to limit or exclude the Club’s liability for death or personal injury caused by our negligence or any other liability which cannot be lawfully limited. However, we will not be liable for any loss, damage or theft of your personal property (see Section 7) or for any illness or injury to you or your guests that is not the result of our negligence. By agreeing to these terms, you waive any and all claims you or your estate may have against the Club for such incidents.

  • Indemnification: If you (or your guest or dependent) cause harm to another person or damage to property at the Club through negligence or willful misconduct, you agree to indemnify and reimburse the Club for any loss, claim, or expense (including legal fees) that results from that action. Similarly, you agree to indemnify the Club for any third-party claims arising from your breach of these Terms.

7. Personal Property and Locker Liability

  • No Liability for Personal Property: The Club does not accept liability for loss, theft or damage to your personal property or that of your guests that occurs on the premises, whether in lockers, in your vehicle, or elsewhere, except where such loss results directly from our negligence. This means that items you bring to the Club are at your own risk. We strongly recommend not bringing valuables (such as jewelry, large amounts of cash, or expensive electronics) into the facility. If you must bring valuables, keep them on your person or securely locked in a locker.

  • Lockers: We provide lockers (daily use and a limited number of rentable lockers) for your convenience. However, using a locker does not guarantee security. Locks can be cut or defeated, and while this is rare, we cannot assume responsibility for the security of locker contents. Do not leave wallets, phones, jewelry, or similar items unattended in unlocked areas. If you rent a locker on a long-term basis, the same principle applies; use at your own risk and maintain your lock. Automobiles: If you use our parking facilities, you park at your own risk. We are not liable for theft of or damage to vehicles or their contents. Always lock your car and do not leave valuables in view to reduce temptation.

  • Towels and Club Property: Club-provided towels, robes, or other amenities are provided as a courtesy (if available) but remain Club property. Members and guests should not remove these items from the premises. Please return used towels to the towel drop. If you accidentally take something home, kindly bring it back on your next visit. Deliberate theft of Club property will result in membership termination and possible legal action.

  • Lost and Found: As mentioned, items found will be held in lost-and-found for a limited time. The Club is not responsible for replacing lost items but will attempt to return found items when possible. Please inquire at reception if you lost something, and leave your contact details so we can reach you if it turns up.

8. Club Employees, Trainers, and Third Parties

  • Staff Authority: Our Club staff, including front desk, fitness instructors, pool staff and managers, are here to ensure a safe and enjoyable environment. Members and guests are expected to follow the reasonable instructions of Club staff at all times. This includes directives related to safety (for example, “please don’t drop the weights” or “swim only in the roped area”), policy enforcement (“you need to shower before entering the pool”), or emergency procedures (“please evacuate – this is a fire alarm”). Failure to cooperate with staff instructions or abuse towards staff is a serious breach of these terms and may result in immediate expulsion from the premises and disciplinary action on your membership. If you have any concerns about a staff member’s instruction, please comply in the moment (unless you reasonably believe it is unsafe to do so) and you may later bring the issue to management for review.

  • Personal Training and Coaching Services: The Club offers personal training services provided by our employed or contracted trainers. Separate fees apply for personal training or coaching sessions. All personal training sessions must be paid in advance unless otherwise agreed by the Club. Cancellations of a booked personal training session must be made at least 24 hours in advance, or you may be charged for the session (emergencies will be considered at our discretion). Training sessions are not transferable and, if not used within their validity period, may expire. We do not guarantee the same trainer’s availability indefinitely; if a trainer leaves or is unavailable, we will assign another trainer or offer a refund for unused sessions. Any results from training (e.g. weight loss, fitness gains) are not guaranteed, as they depend on many factors including your effort and adherence – no liability is accepted for failure to achieve desired results.

  • Independent Practitioners: We may allow certain independent practitioners (such as physiotherapists, massage therapists, or freelance class instructors) to operate or offer services at the Club from time to time. Those individuals are independent contractors and not employees of the Club. If you choose to purchase or use services from them, you are entering an agreement with that provider, and any liability for injury or dissatisfaction arising from those services lies between you and that provider, not the Club. We do vet external practitioners for qualifications, but we are not responsible for their actions. That said, if you have a serious concern about any third-party service provider at our facilities, please inform management. We want to ensure anyone operating here maintains our standards.

  • No Medical Services: The Club staff are not medical professionals (unless explicitly stated for certain practitioners). We do not provide medical treatment or emergency medical care beyond basic first aid. If you have an accident or medical emergency, we will call for appropriate medical help. We do not stock or administer any medications (except basic first aid supplies). The Club is equipped with a first aid kit and [if applicable] an AED (Automated External Defibrillator) for emergency use by trained personnel.


9. Children’s Access and Memberships

We welcome children and young members under suitable conditions. The following rules apply to ensure the safety of minors and the enjoyment of all members.

  • General Supervision: Children under the age of 16 must be supervised by a parent or responsible adult member at all times while on Club premises, unless participating in a specific supervised activity or programme authorised by the Club. Children may not be left at the Club to use the facilities independently. Parents or guardians are fully responsible for their children’s conduct and safety. A child’s misconduct may be treated as the misconduct of the responsible adult member.

  • Parental Agreement: Parents or legal guardians of any member under the age of 18 must sign the membership agreement on the child’s behalf and accept responsibility for compliance with these Terms and Conditions, including payment of any applicable fees. The Club may also require children aged 16–17 to sign an acknowledgement of Club rules.

  • Age Restrictions by Area: For safety and compliance, certain areas have strict age restrictions. These restrictions apply regardless of supervision unless expressly stated otherwise.

    • Gym Floor (Fitness Equipment): No one under the age of 16 is permitted to use the main gym equipment or weight room, except during special classes or teen programs specifically authorised by the Club (with instructor supervision).

    • Group Exercise Classes: Participants in standard group classes generally must be 16 or older. Some classes or sessions specifically designed for younger teens or kids may allow younger ages with instructor approval (e.g. a teen fitness class, or family yoga). Age-appropriate restrictions and supervision requirements will be communicated for any youth programs.

    • Swimming Pool: Children may use the swimming pool only when accompanied and actively supervised by a responsible adult member, in line with the Club’s supervision rules. If designated family swim times are introduced in the future, these will be communicated separately and must be observed. We recommend at most 2 children per adult for effective supervision (and require this ratio for non-swimmers or children under 8). Infants and toddlers must wear swim nappies/diapers. Children under 12 should not use the pool unsupervised at any time, even if they are good swimmers – an adult should be present. If  adult-only swim times are introduced, minors will not be allowed in the pool during those sessions.

    • Spa/Hot Tub, Sauna, Steam: Under 16s are not allowed in these facilities. 

    • Changing Rooms: Children aged 5 or older should use the gender-appropriate changing room (boys with men, girls with women) or a family changing room if available. We understand parents may need to assist young children; where a family/accessible changing room is available, please use it for opposite-gender parent-child pairs. If not available, please be as discreet as possible and inform staff if you need accommodation.

    • Club Classes/Programs for Kids: If we offer specific kids’ programs (like swimming lessons, kids’ camps, etc.), those will have their own age guidelines and rules, which will be provided to participants. Parents may be required to remain on-site during children’s programs depending on the activity and child’s age.

  • Behaviour: Children are expected to follow the Club rules just as adults are. Parents must ensure kids do not run around unsupervised, disrupt other members, or misuse equipment. For example, no playing on gym equipment or in studios outside of organised activities; no loud or unsafe behaviour in any area. If a child is being disruptive or unsafe, we will ask the parent/guardian to intervene. Repeated issues may result in the family’s membership being reviewed or restricted.

  • Children Memberships: The Club offers individual memberships, couple memberships, and children memberships linked to an adult member. Children memberships are subject to an additional fee, as set by the Club at the time of joining. All members, including children members, are bound by these Terms and Conditions. Access rights, supervision requirements, and age restrictions apply individually.

  • Youth Waivers: Upon first joining, a parent or legal guardian must complete and sign a waiver on behalf of any child member, acknowledging the risks associated with Club activities. Nothing in this section limits the Club’s liability where it cannot lawfully be excluded. Parents and guardians remain responsible for supervising their children at all times while using Club facilities.

  • Childcare: (If applicable) If the Club offers a supervised kids’ area or crèche service, separate terms will apply (such as time limits, age limits, and fees). Those services are not a licensed daycare, but a convenience for members for short durations while on-site. You must remain on Club premises while your child is in our care, and respond promptly if paged or called for any issues (e.g. child upset or needs diaper change). See the separate Kids Club rules for more details.

10. Discipline and Club Rights

  • Rule Enforcement: We strive to enforce rules fairly and consistently. If you or your guest violate any of these Terms or posted Club rules, staff may provide a verbal warning or instruction to correct the behavior. If you do not comply or the violation is serious, we may ask you to leave the premises immediately. Club management (including the general manager or duty manager) has the authority to temporarily suspend your membership pending a review, or to issue written warnings for misconduct. We maintain records of incidents, and repeated minor violations can accumulate to result in membership action.

  • Membership Termination by Club: As noted in Section 3, the Club may terminate membership for serious breaches or misconduct without notice. In such cases, you will be notified in writing of the termination and the reasons. Serious breaches include, but are not limited to: violence or threat of violence, hate speech or harassment, vandalism or deliberate damage, theft or criminal activity, any sexual misconduct (such as inappropriate sexual behavior in the Club), use of another’s identity to gain access, or consistent disregard for safety protocols. The Club has zero tolerance for criminal acts on the premises – any illegal activity will be reported to police. If your membership is terminated for cause, you forfeit any prepaid amounts (we will not refund the current month’s dues, for example) as a reasonable estimate of our damages, and you must immediately return any Club property and settle any debts. You will not be allowed entry as a guest in future either.

  • Appeals: If you believe your membership has been unfairly terminated or suspended, you may appeal in writing to Club management or the corporate office. We will review your case, and you will be given an opportunity to present your explanation. However, the Club’s decision on disciplinary matters is generally final. In the case of children’s suspension (Section 9), a parent can appeal on the child’s behalf. We aim to be reasonable and will reinstate memberships if we find a misunderstanding or if we believe the issue can be resolved with assurances of future compliance.

  • Right to Refuse Admission: We reserve the right to refuse entry to anyone, member or guest, if in our judgment that person poses a health or safety risk, is violating Club policies, or is engaging in misconduct. This includes the right to refuse entry to someone who was terminated or banned previously, or someone who is disruptive, even if they are currently a paying member (in which case a suspension will follow). If you arrive and are refused entry, the staff will inform you of the reason and whom you can contact for further discussion (e.g. the manager).

  • CCTV and Monitoring: For security, we employ CCTV monitoring in many areas of the Club (excluding private areas like restrooms, changing rooms, sauna/steam). By being on premises, you acknowledge that your image may be recorded for security purposes. Footage is used strictly for security monitoring and incident investigation, and retained only for a limited time unless needed for a specific investigation (see Privacy Policy for more details).

  • Emergency Situations: In case of emergencies (fire, power outage, etc.), members and guests must follow all instructions from staff or emergency responders. Evacuation routes are posted – familiarize yourself with them. Do not re-enter the building until cleared by officials. We conduct occasional emergency drills; your cooperation is appreciated. If you call emergency services directly (e.g. 999/112) for an incident, please also notify a staff member if possible so we can assist and direct responders to the right location.

  • Facility Maintenance and Repairs: The Club may be required to close certain areas for maintenance, repairs, or cleaning. We strive to do major work during off-peak times or with minimum disruption. However, there may be instances where facilities (like a pool or shower block) are temporarily unavailable. We will communicate significant outages or refurbishment schedules via notices. We ask for your patience during these periods – they are to improve the Club for everyone. Minor disruptions do not entitle members to refunds; however, if a major facility (like the only pool) is closed for an extended period (say more than 2 weeks), we will consider appropriate measures (such as offering use of an alternate facility if possible, freezing memberships, or prorated credit) depending on the situation.

11. General Provisions

  • Changes to Terms or Club Rules: The Club may from time to time make reasonable changes to these Terms and Conditions or to the Club Rules (including opening hours, facility usage policies, or membership structure). We will give members at least 14 days notice of any material changes, either by email, website update, and/or posting a notice on the club notice board. If a change in terms significantly impacts your membership rights or fees, and you do not accept the change, you may terminate your membership by giving written notice before the change takes effect (if you are within a fixed term, you can cancel notwithstanding the term in this scenario). Continued use of the Club after a change takes effect will constitute acceptance of the new terms. We encourage you to review our notices and emails so you are aware of any updates. The most current Terms and Conditions will always be available on our website and at reception.

  • Temporary Closures (Force Majeure): If the Club is forced to close or suspend operations due to circumstances beyond our control (for example, natural disasters, government-mandated shutdowns, pandemics, or other force majeure events), we will freeze all memberships at no cost or extend membership terms for the duration of the closure. We will not charge you for time when the Club is fully closed. If a significant portion of our facilities is unusable for an extended period, similar considerations will apply. However, no refunds will be provided for closures due to force majeure – instead, time will be added to your membership or charges waived for that period. We will do our best to keep members informed and to reopen safely as soon as possible in such events.

  • Transfer of Membership by Club: The Club (Kirkby Leisure Club Ltd) reserves the right to transfer its rights and obligations under this membership agreement to another entity in the event of sale or transfer of the business or its assets. Such a transfer will not diminish your contractual rights – the new owner will honor the existing terms. We will notify you if such a transfer occurs and provide the new company’s details. Members may not transfer or assign their membership to any other person as memberships are personal to the named person.

  • Governing Law and Jurisdiction: These Terms and any disputes arising in relation to them or your membership are governed by the laws of England and Wales. We and you both agree that any dispute that cannot be amicably resolved shall be submitted to the exclusive jurisdiction of the English courts. If you are a consumer residing elsewhere in the UK, you may also have the option to bring proceedings in your local courts under consumer protection laws, but English law will still apply.

  • Rights of Third Parties: This agreement is between you and the Club. Except for any company that may take over our obligations as explained above, no other person has any rights to enforce any term of this contract (for example, a friend or family member who is not the member cannot make a claim on your behalf). The UK Contracts (Rights of Third Parties) Act 1999 shall not apply to this agreement.

  • Severability: If any part of these Terms and Conditions is found by a court to be invalid or unenforceable, the rest of the document shall continue in effect. We may revise the offending clause to best reflect the original intent, to the extent allowed by law. Our failure to enforce any right or provision of these Terms on one occasion shall not constitute a waiver of that right – we may enforce it in the future.

  • Entire Agreement: These Terms, together with your membership agreement form and any referenced policies (such as the Privacy Policy and specific Club Rules), constitute the entire agreement between you and Kirkby Lonsdale Health & Spa Club regarding your membership and use of the facilities. They supersede any prior representations or agreements. You should not rely on any oral representations that are not set out in writing in the agreement. No modification to this agreement will be binding unless in writing and issued by the Club.
